DOJ Finalizes Rule on Web and Mobile Accessibility

On April 9, 2024, the U.S. Department of Justice (DOJ) finalized a rule strengthening requirements for web and mobile accessibility.

The rule updates regulations for Title II of the Americans with Disabilities Act (ADA), specifying that state and local governments must follow the World Wide Web Consortium Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. With limited exceptions for archived or restricted documents, governments will have two to three years (depending on size) to meet the expanded requirements.

In the State of Illinois, the Illinois Information Technology Accessibility Act (IITAA) already requires compliance with WCAG 2.0 Level AA, and the State will soon be updating the IITAA to reference WCAG 2.1 in line with the new rule.
